A state senator would like to keep electric cigarettes outside of kids' hands by developing it a petty offense for merchants to promote the theifs to minors and for minors to purchase them.

"If we'll say minors can't buy regular cigarettes, it does not seem valid to talk about they are able to get access to electric cigarettes," said Sen. Steve Yarbrough, R-Chandler. "Hopefully a few less young people are affected nicotine addictions with this ban."

The so-called e-cigarettes are battery-powered plastic and metal devices that heat a liquid nicotine solution that users inhale being a mist. They're easily obtainable in many hundreds flavors, including cherry, chocolate and beer, plus the flavors of popular cigarette brands.

Though companies often claim they cannot sell to buyers under 18 or that the e-cigarettes are employed help smokers quit, Arizona youth can legally purchase them while that they can't buy cigarettes and tobacco products.

SB 1280 won preliminary approval this week on the Senate Committee on the Whole, putting together a last vote that may send it towards the House. The penalty for just a petty offense is usually a fine up to $300.

Supporters from the bill repeat the fruity or candy flavors is one reasons why e-cigarettes are loved among young adults.

Arizona Attorney General Tom Horne, whose office pushed for just a ban and registered its support to the bill, said e-cigarettes quite often children into addiction.

"It might appear to be an alternate way to get youth enslaved by nicotine is by using these flavors to entice these to begin using these products," Horne said.

David Goerlitz, president of the Tobacco Vapor electric cigarette Association, and that is based near Atlanta, said the industry supports banning e-cigarettes for minors.

"Businesses that sell to kids, shame built in," he explained. "They should lose their license and turn into fined severely, like you would for tobacco. Any law that prevails for tobacco might also want to prevail for e-cigs."

James Sanders, online resources A-Z Smoke Free, an electronic cigarette business run on the internet from his Goodyear home, said he doesn't encourage nicotine use by minors of any type.

His website requires patrons to confirm a box saying they're 18 before they generate a purchase order.

"If they're on the internet and they're by using a charge card they usually say they're 18, I want to trust potentially they are," Sanders said.

When customers shop at his home, Sanders said he asks them for ID if they seems to be younger than 18, though almost all of his patrons are older people that like e-cigarettes rather than smoking.

The U.S. Fda standards has attempt to regulate e-cigarettes as unapproved drug-delivery devices and quit them from being imported into your country without further testing, but several electric cigarette starter kit companies challenged the FDA's authority. The FDA lost in federal court in Washington, D.C., in December, and so on Jan. 24 a request to appeal choosing one was denied.

Right this moment, we're considering our next levels in relation to what we're going to do moving forward,said Jeff Ventura, a spokesman for any FDA Center for Cigarettes.

Because e-cigarettes are unregulated within the federal level, states and municipalities are weighing in to the issue, he explained.

A number of other states will be looking at banning e-cigarettes for minors, and Washington recently passed a ban.

The U.S. Department of transportation said this month so it plans to issue the official ban of e cigarettes on airplanes early in the year.
